Thank you for choosing DeDoggies, the premier digital platform for adopting, training, breeding, and competing with unique digital dogs ("DeDoggies") on the Ethereum blockchain. These Terms of Use ("Terms") govern your use of the DeDoggies platform, including our website www.dedoggies.io, mobile applications, and related services (collectively, "Platform"). By accessing or using the Platform, you agree to these Terms and our Privacy Policy.

1. Agreement to Terms

By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform. You represent that you have the legal capacity to enter into these Terms.

A. Ownership of DeDoggies NFTs

Purchasing a DeDoggie grants you ownership of the corresponding NFT. You have the right to sell, trade, or give away your NFT, subject to these Terms.

B. Platform Content and Trademarks

All content on the Platform, including text, graphics, logos, and the DeDoggies trademark, is owned by us or our licensors and is protected by copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform and its content for your personal, non-commercial purposes only.

4. User Content

A. Responsibility for Your Content

You are solely responsible for all content that you upload, post, email, or otherwise transmit via the Platform. You represent that you have all necessary rights to your content and that it does not infringe or violate the rights of any third party.

B. License to Your Content

By submitting content to the Platform, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, publish, translate, distribute, perform, and display such content in connection with the Platform.

5. Fees and Payments

A. Transactions on the Platform

You acknowledge that conducting transactions on the Ethereum blockchain requires payment of transaction fees ("Gas Fees") and that you are responsible for these fees.

B. Platform Fees

We may charge fees for various transactions and services provided on the Platform. We will provide notice of any such fees before you incur them.

We reserve the right to terminate or suspend your account and access to the Platform if you violate these Terms, engage in illegal activities, or for any other reason at our sole discretion, with or without notice.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform; any conduct or content of any third party on the Platform; any content obtained from the Platform; or unauthorized access, use, or alteration of your transmissions or content.

You agree to indemnify and hold harmless DeDoggies and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

You agree that any disputes arising from or relating to the subject matter of these Terms shall be governed by the arbitration process, location, and rules specified in this section, with no recourse to class actions.
